Polyn – Christmas Scan & Win Promotion

 

TERMS & CONDITIONS

 

The Polyn Christmas Scan & Win Promotion (the “Contest”) is sponsored by Active Capital Ltd. (the “Sponsor”). The Contest is governed by these official rules (the “Official Rules”). By entering and participating in the Contest, each person (the “Entrant”) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by the Sponsor and its agents, are final in all respects. The Contest is subject to all applicable laws and regulations and is void where prohibited by law.

All questions, comments or complaints regarding the Contest may be directed to the Sponsor at the contact email provided herein.

Personal data

By entering this contest participants understand that Active Capital Ltd. (Polyn) will be collecting their personal data to facilitate the contest and hereby consent to the collection, use and processing of such personal data for the purposes of same, including for use on our social media pages in relation to the contest. Such personal data may also be shared with third parties and/or affiliates of Polyn that deliver services to Polyn in connection with the contest. ELIGIBILITY

The Contest is open to Entrants who are registered members of the Polyn Loyalty Program (“Polyn”) and who have registered their Polyn card and provided an email address and/or telephone number prior to the end of the Contest Period. Blackbeard’s winners must be eighteen (18) years of age or older at the time of entry. If the winner is unable to verify their age the sponsor reserves the right to select a new winner. 

The Sponsor reserves the right to extend or shorten the Contest Period at its sole discretion.

Employees of the Sponsor or its subsidiary companies are not eligible to participate in the Contest.

The Sponsor has the right to verify the eligibility of each Entrant and may in its sole discretion refuse, suspend or terminate any person’s participation in the Contest.

Entrants should note that photo identification may be required when claiming the Prize, in addition to any other documentary evidence required by the Sponsor.

 

CONTEST PERIOD

The Contest begins on Thursday, 7th December 2023 and ends on Saturday, 23rd December 2023 (“Contest Period”).

There will be seventeen (17) daily prizes ("Daily Prize") for transactions on , 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 & 23 December 2023.

 

 

 

HOW TO ENTER

In order to be entered in the Contest, Entrants must make a purchase and scan their Polyn card (the “Eligible Purchase”) at a participating retailer (the “Participating Retailer”) during the Contest Period. Daily winners will be randomly selected from specified stores indicated in the below grid. On 23 December the winner will be randomly selected from all of the Polyn participating retailers.

 

There is $50.00 KYD minimum purchase. Entrants will receive one (1) entry per $50.00 KYD in a transaction. Eligible Purchases are exclusive of gift vouchers and/or gift cards.

Participating Retailers include Blackbeard’s, Anchors, Next Chapter, De Sunglass Man, Paradise Villas, North Sound Golf Club and Camana Bay Cinema. A full list of Participating Retailers can be found at https://www.polyn.ky/special-offers/. 

Entrants are encouraged to enter as many times as possible during the Contest Period.

WINNER SELECTION

The Daily Prize selections will be announced 8, 11, 12, 13, 14, 15, 16, 18, 19, 20, 21, 22 & 27 December 2023 on the Sponsor’s social media platforms, the Sponsor will also notify the winners via email and/or telephone call. 50,000 Polyn points ($1,000CI equivalent) will be automatically added to the winning card.

 

 

DAILY PRIZES

Twenty (17) Daily Prizes are available to be won.

  1. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 7 2023 at Next Chapter (Winner selection on 8th December 2023).
  2. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 8 2023 at Blackbeard’s or Anchors (Winner selection on 11th December 2023).
  3. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 9 2023 at Blackbeard’s or Anchors (Winner selection on 11th December 2023).
  4. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 10 2023 at Blackbeard’s or Anchors (Winner selection on 11th December 2023).
  5. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 11 2023at Blackbeard’s or Anchors (Winner selection on 12th December 2023).
  6. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 12 2023 at Blackbeard’s or Anchors (Winner selection on 13th December 2023).
  7. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 13 2023 at Blackbeard’s or Anchors (Winner selection on 14th December 2023).
  8. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 14 2023 at Blackbeard’s or Anchors (Winner selection on 15th December 2023).
  9. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 15 2023 at Next Chapter or De Sunglassman (Winner selection on 18th December 2023).
  10. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 16 2023 at Blackbeard’s or Anchors (Winner selection on 18th  December 2023).
  11. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 17 2023 at Blackbeard’s or Anchors (Winner selection on 18th December 2023).

  14. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 20 2023 at Blackbeard’s or Anchors (Winner selection on 21st December 2023).
  15. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 21 2023 at Blackbeard’s Brac (Winner selection on 22nd December 2023).
  16. 50,000 Polyn Points for a member who has made an Eligible Purchase on December 22 2023 at Camana Bay Cinema (Winner selection on 23rd December 2023).
  17. 50,000 Polyn Points for a member who has made an Eligible Purchase between December 7 & 23 2023at North Sound Golf Club, Camana Bay Cinema, Paradise Villas, Next Chapter and De Sunglass Man (Winner selection on 27th December 2023).

 

Notwithstanding the above, additional terms and conditions may apply to the respective prizes. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the Daily Prize winner.

Any and all applicable taxes and/or duties associated with the receipt or use of any prize shall be solely the responsibility of the respective winner.

 

ADDITIONAL LIMITATIONS

The Prize is non-transferable and non-refundable. The Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives and their respective employees/agents are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of the Prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by the Sponsor. The Sponsor reserves the right to terminate, suspend or amend the Contest (including amending the Official Rules), without notice, and for any reason, including, without limitation, if the Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event that any tampering or unauthorized intervention may have occurred, the Sponsor reserves the right to void suspect entries at issue. The Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for incorrect and/or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise. 

This Contest and these Official Rules shall be governed by and construed in accordance with the laws of the Cayman Islands and the courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising out of or in connection with this Contest.

 

INDEMNIFICATION AND LIMITATION OF LIABILITY

By participating in the Contest, each Entrant agrees to fully indemnify, release and hold harmless the Sponsor and its parent, affiliate and subsidiary companies, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any and all liability, claims, demands, damages, losses or injury resulting in whole or in part, directly or indirectly, from that Entrant’s participation in the Contest and the provision, acceptance, use or misuse of the Prize that may be won or any information that may be considered private. The Sponsor and its parent, affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the Prize. The Sponsor and its parent, affiliate and subsidiary companies, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Contest.

For avoidance of doubt, the Sponsor may, in its sole and absolute discretion, declare that an Entrant who has been drawn or selected as the winner of a Prize is ineligible to receive the Prize including where:

  • such Entrant has won a Prize in a previous Polyn Contest held within the last [three] years; or
  • awarding such Entrant with the Prize could cause damage to the reputation or goodwill of the Sponsor and/or its affiliates parent, affiliate and subsidiary companies.

In such circumstances a new winner will be drawn and/or selected.

PUBLICITY

By participating, each Entrant grants the Sponsor permission to use the Entrant’s name on social media for promotion, marketing campaigns, advertising trade, or any other purpose through any and all medium now or hereafter known (including any Sponsor and sponsored websites, Facebook, Twitter, Instagram or YouTube) without payment of additional consideration, except where prohibited by law.
