TERMS & CONDITIONS - I Paid With Polyn
Polyn monthly contest (“Contest”) is sponsored by [Active Capital Ltd.](“Sponsor”). The Contest is governed by these official rules (“Official Rules”). By entering and participating in the Contest, each party (“Entrant”) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by the Sponsor and its agents, are final in all respects. The Contest is subject to all applicable laws and regulations and is void where prohibited by law.
All questions, comments or complaints regarding the Contest will be directed to the Sponsor at the contact email provided herein.
ELIGIBILITY
The Contest is open to Entrants, where not prohibited by law, who are eighteen (18) years of age or older at the time of entry prior to the beginning of the Contest Period (defined below), who are legally and/or ordinarily resident in the Cayman Islands and who are registered members of the Polyn Loyalty Program (“Polyn”).
In order to be eligible for the monthly prize (defined below) selection, entrants must redeem their Polyn points towards a purchase. All entries must be entered via social media (Instagram or Facebook) by uploading a photo with their redemption purchase and tag @Polyncayman on Instagram or hashtag #IPaidWithPolyn on Facebook. Entries are only valid if full or partial Polyn points were used towards the purchase. Employees of the Sponsor or its subsidiary or affiliate companies are not eligible to participate in the Contest.
The Sponsor has the right to verify the eligibility of each Entrant and refuse participation at its discretion. Entrants should note that photo identification is required when claiming prizes in addition to any other documentary evidence required by the Sponsor.
CONTEST PERIOD
The Contest begins on the 1st of every month and ends on the last day of every month, commencing June 2021 and ending December 2021.
HOW TO ENTER
In order to be entered in the Contest, Entrants must make a partial or full redemption using their Polyn points towards the purchase of a qualifying item (“Eligible Purchase”) at a participating retailer (“Participating Retailer”) during the monthly Contest Period. Entrants will receive one (1) entry per redemption transaction that is accompanied by a post with photo of item purchased using Polyn points on Instagram or Facebook with a tag @Polyncayman or hashtag #IPaidWithPolyn. Eligible Purchases are exclusive of beer, gift vouchers and/or gift cards.
Participating Retailers include Blackbeard’s, Anchors, West Indies Wine Company, Next Chapter, Island Jewellers, De Sunglass Man, Churchill’s Cigars, Paradise Villas, Swarovski Jewelry, Pandora, North Sound Golf Club, La Boutique, Seafire Supply Co. and Camana Bay Cinema. Entrants are encouraged to enter as many times as possible during the Contest Period.
WINNER SELECTION
The monthly prize winners will be selected by random draw by the Polyn administrator and manager. Prior to publicly announcing the winners on our social media platforms, the Sponsor will notify the winners via telephone number and the winners may choose to claim the Prize or opt out of the Contest.
If a potential winner is deemed to be ineligible, that potential winner will be disqualified. For avoidance of doubt, the Sponsor will verify eligibility of entry via the Polyn system (DataCandy) prior to manually adding the points to the prize winner’s Polyn account. The Sponsor shall have 48 hours in which to confirm acceptance of the prize after which the Sponsor reserves the right to select a new winner.
MONTHLY PRIZES
There’s one (1) prize to be won every calendar month for any Polyn member who has made an Eligible Purchase at any participating retailer during each monthly Contest Period. The winner will be able to receive their Polyn points back (up to a value of $250 KYD)
Any and all applicable taxes and/or duties associated with the receipt or use of any prize shall be solely the responsibility of the respective prize winner.
Notwithstanding the above, additional terms and conditions may apply to the respective prizes. Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the monthly winner.
ADDITIONAL LIMITATIONS
All prizes are non-transferable and non-refundable. The Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives and their respective employees/agents are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by the Sponsor. The Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if the Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event that any tampering or unauthorized intervention may have occurred, the Sponsor reserves the right to void suspect entries at issue. The Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for incorrect and/or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
This Contest and these Official Rules shall be governed by and construed in accordance with the laws of the Cayman Islands and the courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising out of or in connection with this Contest.
INDEMNIFICATION AND LIMITATION OF LIABILITY
By participating in the Contest, each Entrant agrees to fully indemnify, release and hold harmless the Sponsor and its parent, affiliate and subsidiary companies, administrator, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents from any and all liability, claims, demands, damages, losses or injury resulting in whole or in part, directly or indirectly, from that Entrant’s participation in the Contest and the provision, acceptance, use or misuse of any prize that may be won or any information that may be considered private. The Sponsor and its parent, affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition, fitness or merchantability of the prize. The Sponsor and its parents, subsidiaries, affiliates, advertising and promotional agencies, and all their respective officers, directors, employees, representatives and agents disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Contest.
PUBLICITY
By participating, each Entrant grants the Sponsor permission to use the Entrant’s photograph, name and likeness and/or a video recording of the Entrant for promotion, marketing campaigns, advertising trade, or any other purpose through any and all medium now or hereafter known (including any Sponsor sponsored websites, Facebook, Twitter, Instagram or YouTube) without payment of additional consideration, except where prohibited by law.
DATA PROTECTION
The Entrant understands that the Sponsor will be collecting his/her personal data (including name and/or image) in connection with this Contest and the Entrant hereby consents to the collection, use and processing of such personal data for the purposes of same. The Polyn Summer Scan & Win Promotion (the “Contest”) is sponsored by Active Capital Ltd. (the “Sponsor”). The Contest is governed by these official rules (the “Official Rules”). By entering and participating in the Contest, each person (the “Entrant”) agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by the Sponsor and its agents, are final in all respects. ELIGIBILITY

The Sponsor has the right to verify the eligibility of each Entrant and may in its sole discretion refuse, suspend or terminate any person’s participation in the Contest. Entrants should note that photo identification is required when claiming the Prize, in addition to any other documentary evidence required by the Sponsor.
CONTEST PERIOD
The Contest begins on Thursday, 1 July 2021 and ends on Tuesday, 31 August 2021 (“Contest Period”).

There is no minimum purchase. Entrants will receive one (1) entry per transaction. Eligible Purchases are exclusive of beer, gift vouchers and/or gift cards.

WINNER SELECTION

Upon the request of the Sponsor, the potential winner may be required to execute and return an Affidavit of Eligibility, Release and Prize Acceptance Form. The Sponsor will verify eligibility of the Prize winner’s Eligible Purchase via the Polyn system (DataCandy). If a potential Prize winner is deemed to be ineligible, that potential Prize winner will be disqualified.

PRIZE
There will be one (1) prize of CI$5,000.00 cash (“Prize”) awarded following the conclusion of the Contest Period to an Entrant who has made an Eligible Purchase at a Participating Retailer during the Contest Period.
